Innocent Spouse

The IRS holds couples who file taxes jointly equally liable for the accuracy of the returns as well as the payment of the resultant debt.  But it’s his debt!  He was trying to get away with not paying, that’s why I divorced him!  He earned all the income!  Why should I be responsible for his tax debt?  Well, get ready for some questions from the folks at the IRS.  Question one: Why did you sign the return?  Then: Why didn’t you read the return when you signed it?  Why did you decide your non-filing husband (or wife, of course) was suddenly going to do the right thing this year?  See where this is going?  The IRS loves to deny Innocent Spouse claims by simply saying: You Should Have Known Better.  And, in these cases, you’re guilty until proven innocent.
